If there are out and out falsehoods, that can be proven by good evidence, then the Idaho house or Senate could, on behalf of the majority of legislators go ahead and sue YAL. The answer to slander and liable is always a lawsuit, and such speech is never protected by the first amendment. Not since day one has the first amendment protected slander or liable.

Section 9 of Article 1 of the Idaho Constitution states, “Every person may freely speak, write and publish on all subjects, being responsible for the abuse of that liberty.”

Hold YAL responsible.

Provably false allegations are subject to defamation lawsuits, so they can be adjudicated and the truth determined. Do we really need any additional legislation to do that? Hefty awards could provide the means to publish the truth widely, fund the next election and perhaps provide deterrence.
